Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between Synergy Data Analytics, LLC (hereinafter, “Synergy,” “we,” or the “Company”) and you, as a user or customer (“you” or the “User”), regarding the access to and use of our website, applications, and data-analytics platform, as well as all related tools, APIs, integrations (including the GoHighLevel integration), content, and connected services (collectively, the “Services”).


By registering, accessing, browsing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and by any policy incorporated by reference (for example, the Privacy Policy and the Cookies Policy). If you disagree with any provision, you must refrain from using the Services.


Note: These Terms contain limitation-of-liability clauses, warranty disclaimers, and a forum-selection clause. Please read them carefully.

1. Service Definition

Synergy provides a SaaS business-intelligence and analytics platform that enables users to upload, process, visualize, and share data through interactive dashboards, APIs, and automation tools. The Services may include, but are not limited to:

  • Dashboards and visualizations: creation and management of real-time dashboards.
     

  • Data storage and processing: cloud infrastructure for data ingestion, cleansing, and transformation.
     

  • Integrations: connectors to external sources (e.g., SQL databases, CRMs, GoHighLevel, ERPs, third-party APIs).
     

  • Automation and alerts: rule-based workflows and notifications.
     

  • Support and training: documentation, webinars, live sessions, and technical assistance.

The features, storage quotas, API limits, and current prices for each plan (Free, Pro, Enterprise) are described on the pricing page and/or in the applicable Service Order.

2. Acceptance and Eligibility

To use the Services, you represent and warrant that (a) you are at least 18 years old or the minimum legal age to contract in your jurisdiction; (b) you possess sufficient legal capacity; and (c) the information you provide at registration is truthful, accurate, and complete. If you act on behalf of an entity, you represent that you have sufficient authority to bind it.

2.1 Text/SMS

Synergy Alerts & Updates
By opting in you will receive commercial and informational messages about Synergy Data Analytics—product news, account reminders, service alerts, and occasional promotions. Message frequency varies.

  • You can cancel the SMS service at any time by texting “STOP” to the shortcode. After we receive “STOP,” we will confirm your unsubscribe status via SMS and you will no longer receive messages. To subscribe again, register as you did originally.

  • If you experience issues with the messaging program, reply with the word “HELP” for assistance, or contact us directly at info@synergydataanalytics.com or at +1 833-382-7305

  • Carriers are not liable for delayed or undelivered messages.

  • Message and data rates may apply to messages we send and receive. Message frequency varies. For questions about your text or data plan, contact your wireless provider.

3. Account Registration

To access advanced features you must create an account. You agree to:

  • Provide accurate registration data and keep it up to date.
     

  • Maintain the confidentiality of your username, password, API token, and secret keys.
     

  • Notify Synergy immediately of any unauthorized use or suspected security breach.
     

Synergy is not liable for losses arising from misuse of your credentials. We may suspend or cancel accounts that violate these Terms, are used fraudulently, or remain inactive for more than 12 months.

4. Use of the Service and User Conduct

You agree to use the Services only for lawful purposes and in accordance with these rules of conduct:

  • Authorized use: The Service is licensed for your internal analytics activities. Reselling, sublicensing, or granting access to third parties without our consent is prohibited.
     

  • Data and content: You warrant that you have all necessary rights and permissions for the data you upload. You must not upload or share unlawful, defamatory, or infringing data, nor personal information without a legal basis.
     

  • Prohibited practices: You may not (i) reverse-engineer, decompile, or evade security measures; (ii) interfere with Service stability (including DDoS attacks, spam, excessive resource use, or crypto-mining); (iii) use the Service for illegal activities, child pornography, sexual exploitation, money laundering, or sanctions violations.
     

  • Integration with GHL and third parties: If you enable the integration, you authorize data transmission and processing on those platforms pursuant to section 4.1.
     

4.1 Integration with GoHighLevel (GHL)

Activating the GHL integration transfers certain data (e.g., contacts, campaign metrics) to servers located in the USA. We manage this transfer as a sub-processor under the Standard Contractual Clauses and GHL’s EU–US Data Privacy Framework certification. You may revoke the integration at any time; however, doing so may limit certain features.

5. Plans, Payments, and Billing

5.1 Prices and Payment Methods


Current prices, accepted currencies, and plan limits are listed on our site or in the Service Order. Payments are processed through Stripe or other authorized processors; by providing your payment details, you authorize the corresponding charge.


5.2 Subscriptions and Renewals


Paid plans are recurring (monthly or annually, as selected). Unless cancelled at least 48 hours before renewal, the subscription will automatically renew for the same period and rate.


5.3 Taxes


Prices do not include indirect taxes (VAT, sales tax, etc.). These will be applied based on the jurisdiction associated with your billing address.


5.4 Non-payment


If a payment fails, we will notify you to update your method. We may suspend Service access after 5 days of non-payment.

6. Cancellation and Refund Policy

6.1 Trial Period


Pro and Enterprise plans include a 14-day free trial. If you do not cancel before the trial ends, the applicable fee will be charged.


6.2 Refunds


Payments are non-refundable except (i) where required by applicable law; (ii) in case of billing errors attributable to Synergy; or (iii) if the Service is cancelled by us without your breach.


6.3 Subscription Cancellation


You may cancel your plan at any time from the account dashboard. Cancellation takes effect at the end of the current billing cycle. Prorated refunds are not provided.

7. Intellectual Property

Synergy (and/or its licensors) retains all intellectual-property rights in the software, source code, trademarks, logos, visualizations, and any content generated by Synergy. We grant you a limited, non-exclusive, revocable, non-transferable license to access and use the Services in accordance with these Terms.
The data you upload remains your property. You grant Synergy a worldwide, royalty-free license to host, process, and display such data solely to provide the Services.

8. Disclaimer and Limitation of Liability

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, Synergy disclaims all implied warranties (merchantability, fitness, non-infringement). Synergy does not guarantee that the Service will be uninterrupted, error-free, or that data will be accurate.


Maximum liability: Synergy’s total liability to you shall not exceed the total amount you paid in the 12 months preceding the event giving rise to the claim, or USD 1,000, whichever is higher if allowed by law.

9. Indemnification

You agree to indemnify and hold harmless Synergy and its affiliates from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from (i) your data or content; (ii) misuse of the Services; or (iii) breach of these Terms.

10. Modification of Services and Terms

We may update or discontinue aspects of the Services at any time, giving reasonable notice when changes are material. We may likewise update these Terms; the revised version will be posted with the “Last update” date. Continued use after the effective date constitutes acceptance.

11. General Provisions

  • Severability: If any clause is found invalid, the remaining provisions remain in force.
     

  • No waiver: Failure to exercise a right does not constitute future waiver.
     

  • Assignment: You may not assign these Terms without written permission. Synergy may assign them in case of merger, acquisition, or asset sale.

  • Force Majeure: Synergy is not liable for failures due to causes beyond its reasonable control (e.g., natural disasters, internet outages, wars, pandemics).

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law principles. Any dispute shall be submitted to the exclusive jurisdiction of the state or federal courts located in Miami-Dade County, Florida. Notwithstanding the foregoing, Synergy may seek injunctive relief in any jurisdiction to protect intellectual-property rights.
